Scope Ark operates an online portal that connects families with independent teachers, and manages scheduling, attendance, and payments for the lessons arranged through it. Teachers are independent contractors; they are not employees of Scope Ark.
2. About the Service
Scope Ark is an online educational platform designed to connect students with teachers and educational specialists through an interactive digital learning environment. Our services may include live lessons, educational follow-up, learning management, communication tools, and other educational services.
Our goal is to provide a professional, secure, and user-friendly educational experience for students, parents, and teachers.
3. Definitions
Platform — Refers to the Scope Ark website, application, systems, and all related services.
User — Any person who accesses or uses the platform, including Account Holders, teachers, or visitors.
Account Holder — The adult parent or legal guardian who registers for the platform, holds the account, and purchases services. The Account Holder is the contracting party under these Terms.
Teacher — A user who provides educational, tutoring, mentoring, or training services through the platform.
Student — The learner who receives the educational services purchased by the Account Holder. Students do not hold their own accounts on the platform.
Content — Includes text, images, educational files, messages, and any material uploaded or shared through the platform.
Services — All services provided by Scope Ark, including live classes, educational management, educational content, communication tools, and technical support.
4. Eligibility
Accounts on Scope Ark are held by adults only. The platform is not intended for registration or use by persons under the age of 18. Students receive lessons through the account of their parent or legal guardian and do not register, log in, or purchase services themselves.
By registering an account, you confirm that:
- You are at least 18 years old and are the parent or legal guardian of the Student, or are an adult purchasing services for yourself.
- You are legally permitted to use the services under the laws applicable to you.
- The information you provide is accurate, current, and complete.
- You are responsible for the security of the Google account used to sign in, and for any activity carried out through your account.
- You are responsible for supervising the Student's participation in lessons.
- Scope Ark may suspend or terminate accounts that violate these terms or provide false information.
5. Acceptable Use
Users agree to:
- Use the platform only for lawful educational purposes.
- Respect all users and avoid harassment, threats, bullying, discrimination, or offensive language.
- Avoid posting illegal, harmful, or inappropriate content.
- Not attempt to hack, disrupt, or gain unauthorized access to the platform or its systems.
- Not use the platform for spam, unauthorized advertising, or unsolicited communications.
- Not impersonate any person or organization.
Scope Ark reserves the right to take appropriate action against violating accounts, including warnings, temporary suspension, or permanent bans.
6. Communication Outside the Platform
Scope Ark aims to protect the quality of its services and the rights of all parties. Users are prohibited from using the platform to exchange personal contact information or arrange educational agreements outside the platform in ways that bypass the platform systems or harm its interests. Scope Ark reserves the right to take action if such behavior is detected.
7. Educational Sessions
- Teachers are responsible for providing lessons professionally and on time.
- Students are responsible for attending sessions on time and preparing appropriately.
- Delays, absences, or cancellations may be handled according to the platform's cancellation and refund policy.
- Scope Ark may reschedule sessions or assign alternative teachers when necessary to maintain service quality.
8. Fees and Payments
8.1 Free trial lesson
We offer a free trial lesson before you commit to any package, so that you can see the teacher and the approach before you pay anything. The trial lesson costs nothing and places you under no obligation to continue.
8.2 Packages are paid in advance
After the free trial lesson, lesson packages are paid in advance. Lessons are scheduled once payment has been received.
8.3 General
- Prices for lessons and packages are agreed with you and shown before you pay.
- Scope Ark may change its prices at any time. A change never affects a package you have already paid for.
- Users are responsible for reviewing service details before payment.
- Payments are processed through third-party payment providers, and Scope Ark does not store bank card details.
8.4 Consumers in the EU and EEA
Paying in advance does not affect your statutory right of withdrawal. Your 14-day withdrawal period runs from the day you purchase a package — the free trial lesson is not a paid contract and does not start it. See section 2 of the Refund and Cancellation Policy for how that right works and what is refunded.
9. Cancellation and Refund Policy
Refunds and cancellations are governed by the Refund and Cancellation Policy, which forms part of these Terms. Scope Ark reviews each case individually to ensure fairness for all parties. Consumers in the EU and EEA should read section 2 of that policy, which sets out a statutory right of withdrawal that overrides anything less generous.
10. Intellectual Property
All intellectual property rights related to Scope Ark, including logos, branding, designs, software, educational materials, platform content, and trademarks, are the exclusive property of Scope Ark or its licensors. No part of the platform may be copied, distributed, sold, or commercially exploited without prior written permission.
11. User-Generated Content
Users retain ownership of the content they upload but grant Scope Ark the right to store, display, review, or use such content as necessary to operate and improve the platform. Users remain solely responsible for the content they share.
12. Privacy and Data Protection
Scope Ark respects user privacy and is committed to protecting personal data according to the platform's Privacy Policy. The platform may collect certain technical or educational data for purposes including improving service quality, enhancing platform performance, providing technical support, and protecting users and the platform.
13. Session Privacy
Scope Ark does not record lessons. We do not capture, store, or retain any audio or video recording of live sessions, and no recording of a session is kept by Scope Ark at any time.
Account Holders are entitled to attend or observe any session in which their Student participates.
14. Limitation of Liability
Scope Ark strives to provide stable and high-quality services; however, the platform cannot guarantee uninterrupted or error-free operation at all times. Scope Ark is not responsible for internet connectivity issues on the user's side, technical failures beyond reasonable control, misuse of the platform, agreements or communications made outside the platform, or user-generated content or behavior. The quality and outcomes of educational services remain a shared responsibility between the teacher and the student.
Cap on liability. To the fullest extent permitted by law, the total liability of Scope Ark to you for all claims arising out of or relating to the services, whether in contract, tort, or otherwise, shall not exceed the total fees you paid to Scope Ark in the twelve (12) months immediately before the event giving rise to the claim.
Excluded losses. Scope Ark shall not be liable for indirect, incidental, special, or consequential loss, or for loss of profit, opportunity, data, or academic outcome, however caused.
What this clause does not exclude. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of the United Arab Emirates, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
15. Account Suspension and Termination
Scope Ark may suspend or permanently terminate accounts in cases including:
- Violation of these Terms and Conditions
- Abuse toward users or the platform
- Fraudulent activity or payment misuse
- Attempts to damage the platform or its reputation
- Illegal use of the services
In serious cases, actions may be taken without prior notice.
16. External Links and Third-Party Services
The platform may contain links to external websites or services operated by third parties. Scope Ark is not responsible for the content, policies, or practices of external services.
17. Changes to Terms and Services
Scope Ark may update these Terms and Conditions. Where a change materially affects your rights or obligations, we will publish the revised version and notify Account Holders at least thirty (30) days before it takes effect. If you do not accept the change, you may close your account within that period and request a refund of any lessons you have paid for but not yet used. Continuing to use the platform after the notice period means you accept the revised Terms.
18. Termination of Use
Users may stop using the platform at any time. Scope Ark may suspend or terminate access to services in cases of misuse or violations of these terms.
19. Governing Law
These Terms and Conditions are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute that cannot be resolved between us will be subject to the exclusive jurisdiction of the courts of Dubai. Nothing in this clause removes any right you may have under the consumer protection laws of your own country of residence.
20. Events Outside Our Control
Neither party is responsible for a failure or delay in performing its obligations caused by an event beyond its reasonable control, including internet or power outages, failures of third-party platforms, natural events, epidemics, or acts of government. Where such an event prevents lessons from being delivered, we will reschedule them or, if that is not possible, refund the lessons affected.
21. Your Responsibility to Us
If Scope Ark suffers loss because you used the platform unlawfully, misrepresented who you are, or breached these Terms, you agree to reimburse us for that loss. This applies only to loss we actually incur and can evidence.
22. Notices
We will send notices to the email address registered on your account, and they take effect when sent. You may send notices to us at info@scopeark.com. Please keep your registered email address current; we are not responsible for a notice you did not receive because your details were out of date.
23. If Part of These Terms Cannot Be Enforced
If any part of these Terms is found to be unenforceable, that part applies to the maximum extent permitted, or is removed if that is not possible. The rest of these Terms continues to apply.
24. Clauses That Survive
Sections 10 (Intellectual Property), 11 (User-Generated Content), 14 (Limitation of Liability), 21 (Your Responsibility to Us), and 19 (Governing Law) continue to apply after your account is closed or these Terms end.
25. The Whole Agreement, and Transfers
These Terms, together with the Privacy Policy and the Refund and Cancellation Policy, are the entire agreement between us about the services, and replace anything said or written beforehand. Nothing in this section limits your rights in respect of a false statement made to you deliberately.
We may transfer our rights and obligations under these Terms to another organisation, and we will tell you in writing if we do. Your rights under these Terms will not be affected. You may not transfer your account or your rights under these Terms to anyone else without our written agreement.
No delay by either of us in enforcing any part of these Terms means that we have given up the right to enforce it later.
